    • This is the last Will and Testament of me
      Mary Cath of Blackwall in the County of Middlesex widow I give and devise to Telford [?]
      Brearley of Harrow Lane poplar in the County of Middlesex Gentleman all that my equal
      undivided third part or share of and in a certain freehold piece or parcel of Ground in the
      Lodge Lane near [Ann?] Green in the Borough of [Derby?] with the several messuages thereon
      formerly in the tenure of Samuel Woodcock[?] and Henry Boam but late of Elizabeth Brearley
      George Turner John Swain Henry Brearley and Eily [?] Wright and also of and in all that
      freehold messuage or tenement in the Borough of [Derby?] aforesaid fronting a Street called
      fhe Friars Gate with the small yard or garden at the Back thereof now or late in the
      tenure of John Ford to hold the same unto and to the use of the said Telford Brearley
      his heirs and assigns forever I give and bequeath to the said Telford Brearley his Executors
      or administrators the sum of fifty pounds and to Elizabeth Brearley of Harrow Lane
      aforesaid Spinster her Executors or administrators the like sum of fifty pounds I also give
      and bequeath to John Cath of Saint Mary at Hill in the City of London his Executors
      or administrators the like sum of fifty pounds and to Henry Kain of Saint Mary at Hill
      aforesaid his Executors or administrators the like sum of fifty pounds and to Henry Kain
      son of the said Henry Kain my gold watch I give and bequeath to John Kain and Margaret
      Kain children of Richard Kain late of Curtain Road in the County of Middlesex Gentleman
      their [repertive? = representative?] or admors the sum of fifty pounds apiece and I do hereby direct the said
      several legacies hereinbefore by me given and bequeathed to be paid and delivered by my
      Executor hereinafter named within one calendar month next after my decease and as to all
      the rest residue and remainder of my real and personal Estate whatsoever and
      wheresoever and what nature or kind soever I give devise and bequeath the same and
      every part thereof unto the said Telford Brearley his heirs executors administrators and assigns
      so and for his and their own use and benefit he and they paying thereout all and singular
      my just debts funeral and testamentary expenses and all other charges and expenses
      whatsoever relating to the Execution of this my Will and I do hereby nominate constitute
      and appoint Henry Dempster Union Street Southwark pawnbroker Executor of this my
      will to whom for that trouble he may have thereabouts I give and bequeath the sum
      of five pounds and hereby revoking all former and other wills by me at any time heretofor
      made I declare this and this only to be and contained my last will and Testament In
      witness whereof I the said Mary Cath have to this my last will and Testament set my
      hand and affixed my seal this twenty second day of September in the year of our Lord
      one thousand eight hundred and twenty nine - Mary Cath - [Seal] Signed sealed published and
      declared by the said Mary Cath the Testatrix as and for her last will and Testament in the
      presence of us who in her presence at her request and in the presence of each other have

      Whereas by my last Will and Testament bearing date the twenty second day of September
      one thousand eight hundred and twenty nine I have given and bequeathed
      Henry Kain the sum of Fifty pounds now I do hereby revoke the same legacy and bequest
      and make void the same I do hereby give and bequeath unto Maria Kain wife of the
      said Henry Kain the sum of fifty pounds for her own and sole and separate use and
      benefit independent of the said Henry Kain her husband and I do hereby declare that the
      same shall not be subject or liable to the debts contract or engagements of the said Henry
      Kain but that her script alone shall be a discharge to my Executor for the same In
      all other aspects I do hereby confirm my said will and do declare this to be a codicil
      thereto to be taken as part thereof In witness whereof I have hereunto set my hand
      and seal this eleventh day of October one thousand eight hundred and thirty - Mary Cath

      From Diana Burns 22 Oct 2011:
      I have just read Mary Cath's will - I wonder what Henry did to upset her? I think it must tie in with the entry in the London Gazette 28 June 1831 page 1298 relating to the Court for the Relief of Insolvent Debtors, and Mary not wanting her money to go to Henry and hence to his creditors but to be the property of his wife alone. It may not even have been anything personal - she just wanted to ring-fence the cash.
